The NOV was issued on <br />December 16, 1994 for "failure to compact coal refuse to 90~ of <br />maximum dry density and to test compaction of lifts." The testing <br />that WFU performed subsequent to the issuance of the NOV showed <br />that the refuse had been compacted to 90~ of maximum dry density. <br />Therefore, WFU requested that the NOV be modified to read, "failure <br />to test compaction of lifts" on the refuse piles. <br />Although the NOV cannot be modified at this time, because it has <br />already been terminated (NOV C-93-156 was terminated on 3/18/94), <br />the Division hereby acknowledges that the refuse pile has been <br />compacted to 90~ of maximum dry density. <br />If you have any questions, please call me at (303) 866-3567 X353. <br />Sincerely, ^ <br />Barbara L.
