authorized. Information on the location and existence of <br />historic resources can be obtained from the Colorado State <br />Historic Preservation Officer. <br />20. Discharges of dredged or fill material may not consist <br />of unsuitable material (e.g., trash, debris, car bodies etc.) and <br />material discharged must be free from toxic pollutants in toxic <br />amounts. <br />21. Any structure or fill authorized shall be properly <br />maintained, including maintenance to ensure public safety, and in <br />accordance with the terms and conditions of this permit. You are <br />not relieved of this requirement if you abandon the permitted <br />activity, although you may make a good faith transfer to a third <br />party. If you wish to cease to maintain the authorized activity <br />or should you desire to abandon it without a good faith transfer, <br />you must obtain a modification of your approval from the <br />appropriate Corps of Engineers office, which may require <br />restoration of the area.. . <br />22. Upon notification from the Corps of Engineers that the <br />work being performed or completed does not comply with or fall <br />within the scope of this permit, the responsible party shall take <br />immediate steps, as directed by the Corps of Engineers, to bring <br />• the work into compliance with this permit. <br />23. This permit does not obviate the need to obtain other <br />Federal, state or local authorizations as required by law, does <br />not grant any property rights or exclusive privileges, does not <br />authorized any injury to the property or rights of others, and <br />does not authorize interference with any existing or proposed <br />Federal project. <br />24. In issuing this permit and giving approval to perform <br />work under this permit, the Federal Government does not assume <br />any liability for damages to the permitted project or uses <br />thereof as a result of current or future activities undertaken by <br />or on behalf of the United States in the public interest, damages <br />to persons, property, or to other permitted or unpermitted <br />activities or structures caused by the activity authorized by <br />this permit, design or construction deficiencies associated with <br />the permitted work, or damage claims associated with any future <br />modification, suspension, or revocation of this permit. <br />25. You must allow representatives from the Corps of <br />Engineers to inspect the authorized activity at any time deemed <br />necessary to ensure that it is being or has been accomplished in <br />accordance with the terms and conditions of this permit. <br /> <br />8 <br />
