• GRAVEL LEASE <br />Thisleaseismadeandenteredintoasofthe TOth day of November , <br />200 6 , by and between Jerry W. Trudell, Brian W. Wilson and DEBE, LLC, Lessors, and <br />Western Gravel, Inc. As Lessee, witnesseth: <br />1. Lessors are the owners of that real properly located in the County of Montrose, and State <br />of Colorado described in Exhibit "A" hereto attached. <br />A portion of the said property is currently licensed by the MLRB, license No. <br />rt-96-008 to Western Gravel, Inc. The said property was previously <br />leased by James M. Carver, Joyce M. Carver, Jerry W. Trudell and Brian W. Wilson to <br />Western Gravel, Inc. The said lease has expired and the Carver interest has since been <br />purchased by DEBE, LLC. This Grave] lease is intended to zeplace the said prior ]ease. <br />2. Lessors hereby lease and remits to Lessee the said property for a period of two _ <br />yeazs, commencing as of the 10th day of November , 2006 <br />3. During the term of this lease, Lessee shall have the right to mine and purchase gravel <br />aggregate from the said property, with associated activities such as crushing and <br />stockpiling. <br />4. Lessee agrees to pay to Lessors the sum of $0.50 per ton for gravel removed from the said <br />property, buy the said rate maybe renegotiated upon an annual basis as requested by <br />Lessors, but the rate shall not unreasonably exceed the prevailing rate in the geographical <br />area for a similaz type of deposit. <br />I • <br />-1- <br />
