<br />RECEIVED <br />OCT 19 1004 <br />a- <br />Division of Minerals and Geo108Y <br />(2) The Office may request the Operator/Applicant to provide additional, reasonable data to substantiate said <br />Operator/Applicant's estimate of the cost of reclamation for all Affected Lands. <br />Please submit proof that notice, of the pemit application was sent to the Board of County Commissioners and to the <br />Board of Supervisors of the Soil Conservation District, pursuant to Subparagraph 1.6.2(1)(a)(ii). <br />1.6.2 General Applicant Procedures <br />(1) The Applicant shall: <br />(a) Prior to submitting the application to the Office, send a notice, on a form approved by the <br />Board;'to"th~tocat-BOazd-of-Cottnty-Cammissiatte~an~t'ttie mining operSttotrls wittun [fie-boundarie3 of a-soil'- -' <br />conservation district, to the Boazd of Supervisors of the soil conservation district. <br />(i) The Applicant shall include proof of such notice with the application at the time the <br />application is submitted to the Office. <br />(ii) Proof of notice shall be in the form of a return receipt of a Certified mailing or a <br />date-stamped copy of the notice acknowledging receipt by the appropriate local Boazd. <br />V EXAiRiT S -Permanent Man-Made Strnrhrrev (Rnlr fi.4.t9~ You must prOVide information sufficient to <br />demonstrate that the stability of any structures located within two hundred (200) feet of the operation or affected land <br />will not be adversely affected. <br />Your application will not be considered submitted until the information listed above is received and found sufficient to begin our <br />review. A decision date will be established 90 days from the date of receipt of all of the requested information. Additionally, if <br />you have already published notice you will need to republish notice, after the Division considers the application submitted. This <br />notice must be published once a week for four (4) consecutive weeks, starting within ten (10) days of the date your application is <br />considered submitted. We will notify you when you should initiate republication of your notice. The final date for receiving <br />comments is the 20th day after the fourth publication or the next regulaz business day. <br />You have sixty (60) days from the above date to submit all necessary documents that the Office needs for an application to be <br />considered filed. If, at the end of the sixty day period, the application has not been determined to be filed with the Office, the <br />Office shall deny the application and terminate the application file. <br />This letter shall not be construed to mean that there are no other technical deficiencies in your application.
