The draft alleges that "Alternative enforcement provisions for individual <br />civil penalties, criminal penalties or suspension or revocation of the <br />permit were not pursued". Individual or criminal penalties were not <br />pursued because, the legal conditions allowing such procedures did not <br />exist. It would have been illegal to pursue these procedures. Also, the <br />permit expired, and was not renewed; therefore, permit revocation and/or <br />suspension were not applicable. <br />5. The draft alleges that "Bonds for reclamation and maintenance were <br />improperly reduced or inappropriately returned to the operator".
