HISTORY
NOV C-92-013
One NOV (C-91-009) has been issued to for the TBM Mine during the
past twelve months.
Storm runoff water was discharged off site from the sediment pond
in excess of permitted water quality limits. Off site damage due to
lack of maintenance of the pond may have resulted in degradation of
the Del Agua drainage, although this was probably not significant
in light of the other storm runoff in the drainage at the time.
However, additional contributions of sediment to the off site
stream (in violation of the Colorado Water Quality Control Act)
certainly had some adverse effect on the hydrologic balance beyond
the permit area.
FAULT
The operator was negligent in not maintaining the sediment pond so
that it had adequate capacity to treat disturbed area runoff from
a storm which apparently was of less magnitude than a l0-year, 24-
hour storm event.
GOOD FAITH
Since the violation has not been abated as of this time, good faith
is not applicable.
c:\wp51\1r87b
~reaic - napia ~ompiiance

.~- ~ ,
-~ •' ~ ~ ~ ~~ ~~%r~~~%~~ Assessment Officer
Slgnatu~-~
~_.~~~; l~ ~l ~~~~er~ Dated ,.,~~7, / y ~z
Name P,hinted
4672E
