This document applies to mining operations where the current permitted mine operntor wishes tonsfer the Reclamation Pemilt
and permitted reclamation responsibilities to a Successor Operator (u new operator). Please follow the ins[mctions provided in this
package for filing an application; Mineral Rules and Regulations and Constnretimt Material Rules and Regulations Number 1.12
(Permit Transfer application requirements) should also be reviewed prior to completing this form.
Elliott Requirements
To apply for a transfer please submit the tbliowing to the Division of Reclamation, Mining and Safely (the Division):
1) A"'Transfer of Pernut and Succession of Operator" application form, signed and notazized by an authorized
representative of BOTH the cunenY petmittee and successor operator,
2) 'the Application Fee of S 100.00 for Hazd Rock operations and $125.00 for Constmction Materials operations;
3) A Performance Wananty Form bearing an original notarized signature of an authorized representative of the successor
operator; and,
4) Financial Wananty:
A) You have the oprion to WAIVE, YOUR RIGHT to a thirty(30) day processing time to allow the Division $me
to recalculate the required 5nancial warranty; or,
II) You may choose NOT 'f0 WAIVE YOL7R RIGHT' to n thirty (30) day processing time. in such case, [he
Division will recalculate the required financial warranty within sixty (60) days from the decision date (the date
the permit is transferred to the Successor Operator). The required RECLAMATION IIOND COL7LD BL-~
SUBSTANTIALLY INCRtiASFD at that time. lfthe financial warranty is increased, you will then be required
to post the additional financial warranty.
Phis application package contains the '"transfer of Permit and Succession of Operator" application form, and a Performance
Warranty form for your use. Rule 4.3 of the Mineral Rules and Regulations and Rule 4.3 of the Construction Material Rules and
Regulations descnbes the various acceptable Financial Warranty types. Please contact the Division to obtain rho appropriate
Financial Rrananty form.
Upon submittal of this application, the application fee, and the replacement performance and financial warranties the Division will
transfer the permit to the Successor tperator. After the transfer is complete the Division will then review the reclamation costs of
the permi[ed operation. 717e Successor Operator will be notified, if additional reclamation bond is required, within GO days of
approval if you do not wave your right to a decision within 30 days. 'f7te Divisionwill notifyboth operamrs upon completion ofthe
permit transfer.
