<br />Memo - J. Stevens, M. Long - 3 - April 13, 1990 <br />- The following chronology is presented to substantiate our previous approval. <br />August 2, 1984 <br />- The findings document for C-84-062 was issued with a Stipulation No. 15 <br />- (copy attached) which reads: <br />"Within 30 days of permit issuance the permittee shall provide the <br />Division, to be incorporated into the permit document, a plan for <br />controlling sediment from the disturbed area above the Homestead <br />Irrigation Ditch." <br />Note that this stipulation applies to the entire area above the Homestead <br />Ditch. <br />December 20, 1984 <br />The operator provided a response to the stipulation which specifically <br />requested a small area exemption for the area above the Homestead Ditch <br />(copy attached). <br />March 21, 1985 <br />Anne Baldridge of our staff wrote a memorandum (copy attached) to <br />Dan Mathews of our staff which stated: <br />"The response for this stipulation was to request a small area exemption <br />for this area. This is a valid request, and I recommend approval, <br />however, I would suggest the construction of a berm on the uphill side of <br />the Homestead Irrigation Ditch to berm the flows from this area." <br />April 4, 1985 <br />The Division requested that the operator "Provide a specific discussion <br />on the sediment control/soil stabilization measures to be applied on the <br />small area exemption area. A filter fabric fence or straw bale berm <br />above the Homestead Ditch, in combination with contour furrowing and <br />chiseling would be sufficient." A copy of this letter is attached. <br />July 15, 1986 <br />The operator responded (copy attached) by indicating that various land <br />management procedures would be used to ensure sediment control, but that <br />measures such as hay bales or other secondary mitigation measures would <br />not be implemented unless problems are noted. <br />October 21, 1986 <br />The Division conveyed an adequacy letter regarding Technical Revision <br />86-1, in which we indicate that the Stipulation No. 15 response applies <br />".., exclusively to the previously reclaimed area above the Homestead <br />Ditch. At this time, the Division grants that this revegetated area may <br />justifiably be designated as a small area exemption." <br />
