I forward the following comment for
your consideration.
If the permanent overburden pile indicated on map number 6 in Section
number 24 will not be disturbed by operations permitted in this perr„it
period, the pile would be considered an existing structure and need not
be brought into conformance with the permanent procram regulations. I
would, therefore, concur x•ith Energy Fuel's position as stated on page
4.09-Z2 of their application.
However, any spoil or underground development waste which will be placed
in a pile, temporary or permanent, must meet t1~e performance standards o:
Rule 4.09. I c.•iIl be clad to review their treatment of the temporary
spoil piles during my review of the application which I hope to complete
late this week or next week-
P:ap number 6 also refers to areas limited to SOa extraction, which i
assume are also potential Alluvial Valleu Floors which theu intend to
• undermine. Needless to say, the implication that 50~ extraction will
prevent subsidence will have to be appropriately technologically
justified. I will loot, forward to the receipt of subsidence information,
wni.ch I also intend to review late this wee): or earlu next weeY..
mab
cc: Ed Bischoff
