Box 783 <br />Trinidad, Colorado 81082 <br />~7 <br />DIVISION <br />Re: Satisfaction of Stipulations 7 and 8 to the TBM Permit No. C-048-81 <br />Dear Mr. Mills: <br />I have completed my review of all of the information submitted by TBM in <br />response to stipulations 7 and 8 to the TBM permit, which require baseline <br />vegetation sampling and submittal to the Division. <br />The information gathered and submitted to the Division is insufficient to meet <br />the requirements of stipulations 7 and 8 and Rule 2.04.10. <br />Trinidad Basin is notified that resampling of the vegetative communities this <br />summer at the mine is being required by the Division. Prior to any sampling <br />TBM must submit, and have approved a vegetation sampling plan as discussed in <br />stipulation No. 7. <br />TBM is further notified that the failure to meet the requirements of these <br />stipulations has caused the Division to issue Notice of Violation C-84-110 <br />(enclosed). <br />If you have any questions please feel free to call. <br />Sincerely, <br />Michael S.
