CV-2001-007 and CV-2001.-008, Request for Extension of
Abatements Deadlines, and Drill Fluids MSDS Information for Abatement
Termination
Dear Mr. Dudash:
As we had discussed, there has not been a sufficient duration of warm weather
to dry the mud pits and soil berms (as well as to thaw the snow within many
areas along the berms), so the ground conditions remain inappropriate for proper
handling and rework of the soil materials. To allow additional drying time, Oxbow
Mining, Inc. ("OMI") requests extensions of the deadlines to the maximum
abatement period (90 days from the date of issuance} for the installation of
erosion control in the field (abatement No. 1 }per NOV No. CV-2001-007 from
June 15. 2001, to July 19, 2001, and iorimplementing the approved Minor
Revision No. 58 (abatement No. 3) from July 01, 2001 io July 19, 2001. OMI
also requests an extension of the deadline for abatement No. 2 of NOV CV-2001-
008from July 01, 2001 to July 19, 2001.
Attached are copies of the MSDSs for the drilling fluids that have been or may be
used during the drilling of the degasification wells. Along with these products, the
drill mud generated from the well construction and contained within the mud pits
consists of rock and soil particles and water. As none of the drilling mud
constituents are hazardous materials requiring special handling, OMI proposes
that appropriate disposal of the drilling mud per abatement No.1 is to be buried
within the reclaimed mud pits. As such, OMI requests that abatement No. 1 of
NOV No. CV-2001-008 be terminated.
Please call me at (970) 929-5834 should you have questions or require further
information.
Sincerely,
~~aC1~Q.Jiy~_
Kath een G.
