The facts supporting EFMC's request to vacate the violation, referencing both items mentioned in the violation, acre eiplained below in detail. 1. Failure to submit the 1996 Annual Reclamation Repord Submittal of the Annual Reclamation Report was an administrative oversight by EFMC, The DMG discussed submittal of the report during a 'telephone conversation with EFMC the week of October 6. EFMC compiled the report on October 10, then mailed the report, to the Division on October 15. Although submittal of the Annual Reclamation Report was past the deadline set forth in Rule, EFMC did not intentionally ithhold information from the Division that might be used to evaluate the progress of reclamation at the site. The only substantial information presented in the report, which may also be found in the DMG's inspection reports, is EFMC'S documentation of reseeding approximately 3 acres of the reclaimed mine site during 11996.
