(Continued) <br />We respectfully request clazification from the Division on whether any lands on or east of the <br />Arkansas River actually were permitted, and that would therefore require release. The lines of the <br />original aliquot parcel descriptions have been added to the Pre-Mining Map to clarify their actual <br />location. <br />If we are to proceed with acreage releases there will be three areas: 1) the NWI/4 NW1/4 NWI/4 <br />NWl/4 of Section 33; 2) the NEI/4 NE1/4 NEl/4 of Section 34, lying easterly of the 8.03 acre <br />Jesse Lee pit; 3) the NE1/4 NEI/4 NE1/4 of Section 34 lying southerly & westerly ofthe Jesse <br />Lee Permit Conversion Boundary. <br />Exhibit C- Pre-Mining & Mining Plan Maps <br />3. The owners' names and type of structures have been added to all buildings, fences, US <br />Highway 285 and the well (see item 4). <br />4. The only well within 600 feet of the affected azeas is that of the landowner. This well has been <br />added to the maps with the statement that it is owned by RAC Ranch, LLC. <br />5. The line weight of Affected Area Pazce12 has been increased and additional Iabels depicting <br />the permit conversion boundary have been added. <br />Exhibit D- Mining Plan <br />CLARIFICATION. The 5th paragraph of the Mining Plan states "Product will be isolated from <br />groundwater by constructing a diversion ditch...". Our Environmental Scientist has clazified that <br />we are not isolating the product from groundwater, but from water tailings from up-gradient <br />agricultural use. Water tailings from up-gradient agricultural use is the only water that we <br />anticipate managing as it flows through the pit. This operation will not excavate to the ground <br />water level in any location. <br />6. The Applicant intends to place a 12' x 24' mobile construction office trailer and a 10' x 70' <br />portable truck scale in the area shown as "Facility Operations Area" on the Mining Plan. The <br />portable truck scale will require a concrete foundation. These items have been added to the <br />Mining Plan. <br />7. The westerly edge of the proposed pit expansion is at elevation 8000, and the existing pit <br />bottom is at elevation 7950 for a total pit depth of 50 feet. Tailings water begins flowing into the <br />existing diversion ditch at approximately elevation 7975. The elevation of groundwater and the <br />surface of the ponds is at elevation 7940. As noted in the clarification above, this operation will <br />not excavate to groundwater. <br /> <br />
