Long <br />Division Dvecbr <br />Please find attached, Seneca Coal Company's second request to extend the abatement <br />deadlines beyond 90 days for NOV C-95-006 and NOV C-95-007. The subject violations <br />were issued 3/31/95. The 90 day period closed 6/29/95. Abatement requirements for <br />both violations included submittal of a TR and field implementation of the designs <br />approved in the TR following fmal approval by DMG. DMG issued its proposed <br />decision to approve the submitted TR on 7/14/95, but Steamboat Pilot will not publish <br />our proposed decision until 8/3/95. Public comment period will close 8/14 j95, allowing <br />14 days for field implementation of the plans approved in TR-22. Seneca's request states <br />that this extension is necessary to allow time for field implementation following final <br />approval of TR-22. <br />Rule 5.03.2(2)(c) lists the five circumstances which may qualify a surface coal mine for <br />extension of the abatement deadline beyond 90 days. Approval of TR following the <br />close of the 90 day period is listed as one of the qualifying circumstances. I recommend <br />approval of the abatement deadline to 8/28/95. <br />
