<br />j • <br />STATE OF COLORADO <br />MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />IN THE MATTER OF: River Valley Rock, Inc ) NOTICE OF VIOLATION M-94-020 <br />3600 West 0 Street ) AND <br />P 0 Box 967 ) CEASE AND DESIST ORDER <br />Greeley, Colorado 80632 ) <br />T0: River Valley Rock, Inc. and all other persons engaged in or owning or <br />controlling the following operation: Herman Feit Pit located in Section 26, <br />T6N, R66W, 6th P.M. in Weld County, Colorado <br />FINDINGS OF FACT <br />Pursuant to the authority vested in the State of Colorado Mined Land <br />Reclamation Board by C.R.S. 34-32-124, the Board hereby makes the following <br />findings of fact: <br />1. River Valley Rock, Inc. is permitted to conduct a mining operation under <br />the terms of Permit M-77-522 located in Section 26, Township 6N, <br />Range 66W of the 6th P.M., in Weld County, Colorado. <br />2. The Mined Land Reclamation Board conducted a Formal Public Hearing on <br />April 28, 1994 to consider possible violation of the terms of Permit M-77-522 <br />and C.R.S. 34-32-101 et seq. <br />3. The Division of Minerals and Geology presented evidence at the Form,sl <br />Public Hearing on April 28, 1994, demonstrating that: <br />a. River Valley Rock, Inc. suceeded operatorship on Permit No. M--77-522 <br />in 1989. <br />b. On 3/24/94 the Division received a complaint that mining was <br />occurring at the site outside the permit boundary. <br />c. On 3/31/94 the Division inspected the 18 acre permit area. A <br />total of about 65 acres had been disturbed by mining and <br />mining-related activities. <br />NOTICE OF VIOLATION <br />Based upon these same Findings of Fact and in accordance with <br />C.R.S. 34-32-124(6), the Colorado Mined Land Reclamation Board hereby Finds <br />River Valley Rock, Inc. to be in violation of Permit M-77-522, specifically <br />C.R.S. 34-32-116(7)(h) of the Colorado Mined Land Recamation Act. <br />
