LOnX
O Dinsion Dneaor
FROM: Michael Long, Director ~ ~!.'
RE: Rimrock Strip (File C-89-074); NOV -93-151
I have reviewed the above referenced Notice of Violation issued to
Rimrock Coal Company on December 6, 1993. The operator received
the violation on December 9, 1993 in Littleton, Colorado. The
operator completed the on-site inspection at the mine within two
days, despite the distance from the operators office to the
inactive mine site. I find that some amount of good faith
reduction is warranted in this case. Therefore, as Division
Director, I am electing to exercise my discretion in this matter.
I hereby find that a good faith reduction in the amount of $100 is
warranted. Therefore, assuming that the operator signs the
Settlement Agreement, the civil penalty due shall be $550.
