Cottony Division Director Natural Resource Trustee MEMO TO FILE # M-1991-083 From: Berhan Keffelew On September 9,2004 around 5:15 p.m., I received call from Ms. Kate Fay regarding the above application. She stated that she just sent via over night mail the objection withdrawal letter, signed by all the objectors to DMG and Mr. Joe Ggaliano, the operators consultant, which states, as long as all the conditions agreed upon by both the objectors and the operator are part of the conditional, approval of the conversion application. In addition, Ms Fay wanted some corrections to the inspection report dated 8/30/04 on the second page (the narrative portion of the report) but was dated as 9/30/04 on the first page in error. She also wanted the statement "parties exchanged the list of witnesses and Exhibits they planned to present during the hearing, and copies of the NRCC comments were provided to Ms Fay", to state as, both exchanges took place at the end of the inspection not during. She also wanted the statement, "Both Parties agreed to resolve their differences prior to a hearing", to state, "Both parties agreed to work to resolve their differences". She also wanted her last name that was spelled as Fey incorrectly to be replaced with Ms. Fay. I apologize for the spelling error. Spell check corrected it as Fey, and I did not catch it.
