Violstion C-91-014 wss issued as the result of the concerns addressed by item 3 of the Ten Dsy Letter, Y-91-02-370-003 TV4, issued by OSM. Item 3 sddressed the fsilure to design snd construct sediment ponds snd treatment facilities st five locstions st the Neva Elk Mine. wFC wss requested to submit design informstion for the five sress snd then verbslly told not submit sny informstion. WFC's file for the TDL revesled CMLRD snd OSM hsve been debating whether the sress were ponds or impoundments. Two locations, contsinment sress 1 snd 2 st the West Portsl, were previously spproved in the permit spplicstion snd hsve been removed from the NOV. The three remsining sress sre locsted next to the refuse belt. The contsinment sres locsted north of Highwsy 12 wss spproved ss minor revision 18 on Februsry 9, 1989. The contsinment sres locsted south of the highway snd esst of the refuse belt wss shown on the map for minor revision 15, Drsinsge Plsn Change. The third contsinment sres south of the highway snd west of the conveyor hss not been formslly sddressed but has been in service during numerous on site inspections. During the months of July snd August (to dste) there hss been nesrly 11 inches of precipitation. The five containment sress hsve functioned properly, containing sll runoff snd sediment from their respective drsinage sress.
