,~ .;~ <br />Page Two <br />M Long <br />1/15/97 <br />We aze confident that Mr. Mueller will confirm that this is the case and he may be <br />able to shed some light with regazds to the recent mining activity. <br />Having said that, Adience Inc. fully intends to work with the State and resolve <br />issues that aze our obligations. It is our belief that the clay mine has remained <br />within the permitted 9.9 acre disturbance azea. However, since the State wishes <br />fiuther qualification, we have secured the services of Valley Surveyors to provide <br />a survey and the boundary markers. Tom Schreiner with your office notified us <br />that the survey should be received by January 17, 1997. The surveyor is diligently <br />working to meet this deadline, but because of recent bad weather conditions, they <br />can not honor this date. We hope to have it completed by January 22, 1997 (the <br />original deadline); however, that also would be contingent on good weather. We <br />would hope the State would provide an extension to the deadline(s) setforth. <br />Adience Inc. respectfully requests the State to reconsider it's proposed <br />enforcement actions against us and grant an extension on it's receipt of the survey. <br />We have a permit for our mine activity, posted a $36,500 financial warranty and <br />will have the markers placed, as required However, we do not believe that we <br />should be held answerable for activity outside of our clay interest. <br />Yows very truly, <br />Gary D.
