The operator received
the violation on December 9, 1993 in Littleton, Colorado. The
operator completed the on-site inspection at the mine within two
days, despite the distance from the operators office to the
inactive mine site. I find that some amount of good faith
reduction is warranted in this case. Therefore, as Division
Director, I am electing to exercise my discretion in this matter.
I hereby find that a good faith reduction in the amount of $100 is
warranted. Therefore, assuming that the operator signs the
Settlement Agreement, the civil penalty due shall be $550.
