(Page 2) <br />MINE ID # OR PROSPECTING ID # M-1977-560 <br />INSPECTION DATE 11/30/2006 <br />INSPECTOR'S INITIALS DEG <br />This inspection of Permit Number M-1977-560 (Rocky Ford East Pit) was conducted by Deb E. G6nima of the DRMS as part of <br />the routine monitoring and inspection protocol. Herb K. Pearson and Wayne Adams, Valco, Inc. were present during this <br />inspection. The pit is located 2 miles east of Rocky Ford, CO on Highway 50, and currently consists of approximately 189.2 <br />acres. <br />The permit boundaries and the mine entrance sign are well-marked and all activities and completed work at the time of <br />inspection appeared to follow the guidelines and regulations set forth by the state and the mining and reclamation plans for the <br />pit, and no additional problems are noted for this site. Portions of the site are stable with vegetation, and no disturbance was <br />observed outside of the approved permit boundaries. <br />There appears to be no offsite erosion, and while long-term (greater than 72 hours) water retention was observed, the Division <br />has an approved Substitute Water Supply Plan on file. On August 14, 2006 the Division received confirmation from the Office of <br />State Engineer (OSE) that the substitute water supply plan submitted to OSE has been approved forthe period of June 1, 2006 <br />through May 31, 2007. This confirmation has been made part of the permanent permit record in the Division's imaging system. <br />As a result of the Tamarisk population problem noted in the most recent (previous) inspection report performed on September <br />8, 2003, the operator had created a weed control and management plan. During the November 30, 2006 inspection a small, <br />contained parcel with Tamarisk was noted (see photo 2). However, given the minimal population of this weed species, it <br />appeared to this inspector that the operator has continued to consistently implement and maintain the weed control plan. This <br />plan should be submitted to the Division in writing, to ensure that it becomes a part of the permanent record at the Division, and <br />should include specific control measures applied, a schedule of when the control measures are applied, and apost-spray <br />monitoring plan on or before April 1, 2007 (see Problem No. 2 on pg 3). <br />The topsoil stockpile is located along the southern perimeter of the main pit. There are numerous material stockpiles that are <br />situated near the center of the site (see photo 1). There were numerous pieces of equipment on site at the time of this <br />inspection, but no evidence of fuel or hazardous materials contamination was observed. Use of secondary containmentforfnel <br />was noted by this inspector. <br />During this inspection there seemed to be some confusion regarding the approved acreage and history of the site. After some <br />research into the background of the permit, there seems to be a discrepancy with regard to the acreage of the permit area. This <br />inspection report also includes approved maps that were provided to the Division during various stages of the life of the permit. <br />In order to resolve this problem, please provide the Division with a map and an explanation of the official acreage for this permit <br />on or before April 1, 2007 (see Problem No. 2 on pg 3). Please note that no part of the permit area has been released, <br />therefore all portions of the map(s) designated by a yellow highlighted line note the current official permit perimeter boundary, <br />and should be designated on the ground as such using signs like the ones on the permit area east of CR 22. This includes the <br />portion of the permit area where the partially demolished batch plant is located. The permit boundary tine is not in question; <br />rather it is the total acreage within the yellow perimeter line that remains in question. <br />For future reference, this site is correctly positioned in the DRMS online GIS. <br />Responses to this inspection report should be directed to Deb E.
