b2.05 APPLICATION FOR PERMIT FOR SIIRFACE OR UNOERf,ROIIND MINING -- MINIMUM REQUIREMENTS
• FOR OPERATION ANO RECLAMgTION PLANS.
2.05.b Mitigation of Surface Coal Mining Operation Impacts contd.
(1)(a)cont'd.
Department of Health. Initial approval of the permit
would he obtained prior to the beginning of construc-
tion activities. A copy of the initially approved per-
mit would be submitted to the Division upon receipt.
(1)(b) No change.
(2)(a)(i) A golden eagle aerie is located approximately 1,7.00
feet east of the proposed return portal and is shielded
from sight of the construction area by a narrow ridge.
A Bureau of Land Management Wildlife Biologist and a
U.S. Fish and Wildlife Service Specialist inspected the
site of the portals construction and determined that
mining operations on the site would not cause more im-
pact to the eagles than that of the existing operations
(see RLM correspondence, attached). Surface hlasting
may disturb brooding adults. If the nest is active
this year, CWI may delay surface blasting until after
July 1 or after the eagles stop brooding the young or
request a specialist to observe the nest during initial
• blasting to determine if the eagles would he affected.
If no impact is exhibited, blasting would continue as
neetled.
(2)(a)(ii) - (2)(a)(iii)(A)
No change.
(2)(a)(iii)(R)See section 2.05.6(2)(a)(i).
(2)(a)(iii)(C) - (3)(a)
No change.
(3)(a)(i) The areas of the proposed rock slope portals and rock
fills are within the existing disturbed area of the Or-
chard Valley Mine site and drain to a series of exist-
ing sedimentation ponds. No additional impact to the
hydrological balance nor protection measures are pro-
posed.
(3)(a)(ii) - (6)(f)(v)
No change.
•
12
