A copy of the initially approved per- <br /> mit would be submitted to the Division upon receipt. <br />(1)(b) No change. <br />(2)(a)(i) A golden eagle aerie is located approximately 1,7.00 <br /> feet east of the proposed return portal and is shielded <br /> from sight of the construction area by a narrow ridge. <br /> A Bureau of Land Management Wildlife Biologist and a <br /> U.S. Fish and Wildlife Service Specialist inspected the <br /> site of the portals construction and determined that <br /> mining operations on the site would not cause more im- <br /> pact to the eagles than that of the existing operations <br /> (see RLM correspondence, attached). Surface hlasting <br /> may disturb brooding adults. If the nest is active <br /> this year, CWI may delay surface blasting until after <br /> July 1 or after the eagles stop brooding the young or <br /> request a specialist to observe the nest during initial <br />• blasting to determine if the eagles would he affected. <br /> If no impact is exhibited, blasting would continue as <br /> neetled. <br />(2)(a)(ii) - (2)(a)(iii)(A) <br />No change. <br />(2)(a)(iii)(R)See section 2.05.6(2)(a)(i). <br />(2)(a)(iii)(C) - (3)(a) <br />No change. <br />(3)(a)(i) The areas of the proposed rock slope portals and rock <br />fills are within the existing disturbed area of the Or- <br />chard Valley Mine site and drain to a series of exist- <br />ing sedimentation ponds.
