A numh~ of maintenance items were identified du rng <br />the inspection U.' stale personnel that required compliance U}• the <br />operator within a prescribed time. I will address those areas in the <br />main bode of this report. One question was raised Uy the state ' <br />regarding the design criteria for the new diversions recenrl}• Uuilt for <br />drainage control Uelow the new expansion area. !+e were ~maUle to find <br />the approved design for the diversions in the approved mine plan. The <br />operator was going to make a more thorough review of their data for the <br />crossections and P1r. Routten said he would also check their files for <br />the information. If it was not found, failure ro have an approved <br />design would result in a vioation. <br />? issued Ten Day Notice !l:42-02-244-2 with two parCs for potential <br />violations noted durine the inspection that were not addressed Uy tite <br />RtaCe. t'iol.ation number one was issued For the operator's failure to <br />remoee topsoil and\or approved subsoil from areas before disturbance of <br />areas affected U~ surface coal mining operations. Inpsoil and or an <br />approved subsoil suUstinrte was not pulled from the area prior to <br />building the diversions. They were pur in for the recent mine expansion <br />for drainage control ir7 Section 15 and 16. Company officials said that <br />tl:e total combined length of the diversions shore the toF~soil was not <br />cullod is al:prosimatel~' 16,000 feat and overall they average ts:elva feet <br />
