Avg ~7-ZSa.//d'~ <br />MLRB MILIUTES Page 4 <br />AGENDA ITEM 14 - MACAR PtINERALS(OC fit, File No. 79-38 <br />Staff presentation was made by Reclamation Specialist, Marion Dodson Paul, regarding an <br />amendment to a 110 limited impact permit. 'f he permit, area is being expanded from <br />1.79 acres Co 8.42 acres in respogse to the [seed for an adequate sediment control <br />system, as stipulated in their permit. Staff recommends approval of this amendment <br />by the Board, with no bond increase. So P10VED, SECONDED and PASSED. <br />AGENDA ITEM 19 - GRIN R. SPIELERS, File No. 80-1v3 <br />~~~, Staff presentation was made by Reclamation Specialist, Bob Campbell, regarding <br />the Orin R. Spillers gravel operation in La Plata County. Copy of letter of <br />objection was submitted to the Board together with a copy of Petition of <br />Protest which had been received by staff. Staff indicated that the application <br />has been received by the staff but operation was started prior to approval of <br />application, Pir. Spillers indicated that he purchased the operation a few months <br />ago and has not operated yet. <br />i It was AtOVED that the Orin R. Spillers operation, File No. 80-1G 3, be found in <br />violation of operating a sand and gravel extraction operation without a permit <br />- by virtue of Jim Schmieding's visit to the site in July, 1980, and an immediate <br />cease and desist be issued on all mining operations on the property and that <br />consideration for civil penalty be deferred until a subsequent meeting of the <br />Board. SECONDED and PASSED. <br />The operator requested continuance of his permit application. So MOVED with <br />note that the application as received was deficient with respect to the appropriate <br />placement of the application at the county office. SECONDED and PASSED. <br />AGENDA ITELS 22 - PIONEER SAND COPiPANY, I[1C., File No. 80-156 <br />Staff presentation was made by Reclamation Specialist, Bob Campbell, regarding the <br />Pioneer Sand Company gravel pit operation in E1 Paso County, presenting the Board <br />with a copy of an objection received by the staff from NBH Land Company, owner of <br />property nearby and adjacent to the proposed mine. Staff indicated that the E1 Paso <br />County Planning Commission has recommended approval to the E1 Paso County Commissioners <br />at their meeting on August 28. After considerable discussion, <br />It was PfOVED Chat all of the objections presented are either invalid or have already <br />been taken care of; the operator does have legal right to enter, the Board does <br />find that this is a separate operation of less than ten acres, and other issues have <br />been resolved by Che company. SECONDED and PASSED. <br />It was recommended by the staff that the Board approve the permit application with <br />bond set at $2,500. <br />It was MOVED that the Board approve the application of Pioneer Sand Company, File <br />No. 80-156, with bond set at 52,500 with the condition that the special use permit <br />is approved by the Board of County Commissioners. SECONDED and PASSED. <br />
