Preliminary review of the information <br />received determined that the following items must be received before the Division can consider yow application as being submitted and <br />technical review can begin: <br />RXHTRTT N - Snnrce of T.egal Rjght M F.nter (Role 6.4.141: You must provide the source of yow legal right to en[erand <br />initiate a mining operation on the affected land. <br />FXHIRIT t1 - nwner(,SLOf Record of Afferfed T.and ($yrfare Areal and Ownerc of Snhctanre to he yTined ( Ile <br />5.9.151: Please submit a complete list of all owners or show the owners on yow map in Exhibit C. <br />F.XHTRTT O - Prnnf of Mailing of Nnticec to Cmmty Commissioners and Snil Cons rvatinn District (Rule fi.4.171: <br />Please submit proof of actual delivery or proof of mailing by Certified Mail, return receipt requested, of Notice of the <br />Application to the local Board of County Commissioners and, if the mining operation is within the boundaries of a Soil <br />Conservation District, to the Board of Supervisors of the Soil Conservation District. <br />Yow application will no[ be considered submitted until the information listed above is received and found sufficient to begin our - <br />review. A decision date will be established 90 days from the date of receipt of all of the requested infotmatioe. Additionally, if you <br />have already published notice you will need to republish notice, after the Division considers the application submitted. This notice <br />must be published once a week for fow (4) consecutive weeks, starting within ten (10) days of the date yow application is considered <br />submitted. We will notify you when you should initiate republication of yow notice. The final date for receiving comments is the 20th <br />day after the fourth publication or the next regular business day. <br />You have sixty (60) days from the above date to submit all necessary documents [ha[ the Office needs for an application to be <br />considered filed. If, at the end of the sixty day period, the application has not been determined to be filed with the Oftice, the Office <br />shall deny the application and terminate [he application file. <br />This letter shall not be constmed to mean that there are no other technical deficiencies in your application.
