<br />Chronology of Events Page 3 <br />March 3, 1993 <br />February 5. 1993: Phone conversation with Kathy Welt of MCC. MCC <br />did not want to sign the renewed permit <br />document because she (Ms. Welt) questioned the <br />status of some of the stipulations. I <br />explained to her that the status was not all <br />that important, only the wording of the <br />stipulation, and we could resolve the status <br />during the process of evaluating Technical <br />Revision 64. I told her a couple of the <br />stipulations would have to be looked into <br />further. I did make a mistake on the status of <br />one stipulation, and the others, regarding <br />changing the date of compliance, is not done. <br />The Division just updates the file to show that <br />these deadlines were extended. <br />Februarv 8. 1993: Draft adequacy letter written by the Division to <br />MCC asking for more information to review <br />Subsidence Report received January 11, 1993, <br />taking into consideration that the Division had <br />not received a report from MCC since November <br />1990. Gave to David Berry to review. <br />Fe ruarv 12. 1993: Receipt of MCC's signed permit with cover <br />letter. (The cover letter is attached). <br />Februarv 16, 1993: After reviewing above letter, David Berry <br />proposed that the Division should issue a <br />violation since the report was not received for <br />1 '~ years. He asked me to research MCC's <br />requirements regarding their subsidence reports <br />to verify this proposed violation. <br />February 16-17. 1993: Research completed. Included, meeting with <br />Jim Pendleton of the Division to review the <br />stipulations regarding subsidence at the <br />West Elk Mine. He was also asked when the <br />last time he reviewed a report from West <br />Elk. (He had reviewed all previously <br />submitted reports). His files show a <br />memo, dated January 3, 1991, which reviews <br />a report dated October 1990. This <br />corresponds with the specialist and public <br />copy of the file. <br />Februarv 19, 1993: Violation C-93-006 is issued to MCC for failure <br />to submit a semi-annual subsidence report on a <br />semi-annual basis. Kathy Welt of MCC is <br />notified by telephone. <br />
