Basin is unwilling to furnish surety pursuant to C.R.s. <br />34-48-106 with the Board. Even if Basin were willing, Basin <br />understands the Board would not accept it. The Board has no <br />jurisdiction regarding the cited statute. <br />Basin is urlwfiling to furnish such surety to Raton Wsst in the <br />amount requested or tot the potential damages noted in the April <br />5th proposal. Raton West owns 1lttle if any of thn ourlace <br />property under which Basin will mine in the next five year permit <br />period. Future mine plans are not well defined enough at this time <br />to justify broad bonding, to protect as yet unbuilt surface <br />improvements.
