As I have indicated to <br />you, both on Apri1.22, and previously, there :are dome ampects of <br />the proposal.thnt.make sense. and that may .be fruitful areas for <br />fut_ura.:diacuselone between, our.reapective_.clients. We are always <br />raedy~to~diecusa-issues-that will minimize-potential frictions ~- <br />However, we have concluded, based on n number of factors I <br />will detail below, that proceeding along the lines suggestsd in the <br />April 5th letter and proposal would not be in Basins best <br />interests, and is not necessary at this time to protect the <br />interests of lot owners.in the Rancho Escondido subdivision. <br />Consequently, we have not included a counter proposal with this <br />letter. <br />Our concerns .with the proposal fall into two major categoriaa, <br />general and specific. Our general concerns include the following: <br />1. This agreement would commit Basin to accept a broad range <br />of liability in a currently unsettled area of law. As we have <br />discussed numerous times, Basin recognizes its obligation to comply <br />with the law, and understands there are fairly broad requirements <br />to protect aurfaca owners from the affects of subsidence. Basin <br />has responded to stipulations in the propoaad Pindinga for renewal <br />
