PAGE 2 <br />The gate valve leak at pond 007 was also dripping a minimal <br />amount of water. The water leaking out at the time of inspection <br />was in compliance with applicable water quality standards and <br />effluent limits. Normally, the valve seals when closed. The valve <br />had been closed the night before. There waa no indication of <br />leakage when closed. The valves are closed as the pond level <br />reaches the desired level. Since this is done while compliance <br />water is discharged, the leak from the valve is also in <br />compliance. Water leakage from this valve was estimated at less <br />than 1/a gpm, however, it appeared *_o be a let less. During the <br />previous weeks, the increase precipitation events have caused this <br />pond to be discharged more frequently. The increased use of the <br />valve may have contributed to additional wear on the gaskets. <br />This violation was written for failure to maintain primary <br />spillway structures. Both structures are inspected at least weekly <br />and more often during times of frequent precipitation. Necessary <br />maintenance and repairs are done when required. These instances <br />are minute in nature and should not be classified as violations. <br />These problems are not cases of neglect or inattention. They are, <br />however, a case of normal wear for pond 007 and a case of a <br />previously unidentifiable problem surfacing. Basin Resources will <br />be replacing pond 007 valve with a newer, better sealing valve and <br />pond 008's riser will be repaired to give a complete seal. <br />Basin requests this violation be vacated. The severity and <br />extent of these issues should not warrant classification as a <br />violation.
