The <br />Division has studied these photographs and agrees that the road in <br />question was pre-existing at the time the Refuge Pit was permitted. <br />At the time of inspection, the only documentation the Division had was <br />the map of the site (which Moffat County included in the permit <br />document) that showed the previously mined pit as the only pre-law <br />disturbance on site. <br />Since Moffat County has submitted information that indicates that the <br />disturbance was already in existence at the time the Refuge Pit was <br />permitted, the Division will withdraw the Possible Violation hearing. <br />It is gratifying to note that Moffat County has a policy of reclaiming <br />all disturbance on the site whether pre-law or not. As you are aware, <br />the DMG does not require reclamation of pre-law disturbance. <br />If you have any questions, please contact me. <br />// ----' <br />Carl B.
