BANTA, Director <br />November 30, 1987 <br />Representative, Jim Dyer <br />Colorado House of Representatives <br />State Capitol <br />Denver, Colorado 80203 <br />Re: Update on La Plata Coal Corporation's La Plata No. 1 Mine (our File <br />No. C-87-073) <br />Dear Representative Dyer: <br />As you requested, this letter will serve to update you on the outcome of La <br />Plata Coal Corporation's hearing before the Colorado Mined Land Reclamation <br />Board on November 19, 1987 and the current status of the project. <br />The Board found that La Plata had conducted surface coal mining operations <br />without a permit and had disregarded a Division Cessation Order to stop such <br />activities. La Plata was assessed civil penalties of E18,250.00 of which <br />x4,500.00 will be suspended upon obtaining a permit. Joe Carpio of La Plata <br />Coal fully acknowledged that the activity was conducted without a permit and <br />indicated to the Board that the civil penalty assessment was appropriate. <br />However, he also indicated that he may have difficulty paying the civil <br />penalty within the prescribed timeframe. We will try to work with him on that <br />problem. <br />I am pleased to add that La Plata obtained funds and clarification from the <br />U. S. Bankruptcy Court for the required reclamation bond and was issued a <br />permit on November 23, 1987.
