<br /> <br />-z- <br /> <br />CEASE AND DESIST ORDER <br />Based upon these same Findings of Fact and Notice of Violation, and in <br />accordance with C.R.S. 34-32-124(2),(6) and (7) the Colorado Mined Land <br />Reclamation Board hereby orders Mr. Leonard Loukonen, Loukonen Bros. Stone Co. <br />to: <br />1. Cease and desist from conducting the following mining operations at the <br />Loukonen Quarries - Permit M-81-277: Cease and Desist all mining and <br />mining-related activities outside the current permit boundaries until <br />corrective actions are completed. <br />2. Mail, within one (1) day after receipt of this Notice, to the Mined Land <br />Reclamation Board, written notice of your compliance with paragraph one (1) of <br />this Cease and Desist Order. <br />3. Complete the following corrective actions: <br />a. Submit a complete amendment or conversion application to the <br />Division by 6/24/94 which includes all disturbed lands by mining and <br />mining-related activities. <br />b. Obtain an approved amendment by 7/24/94 or an approved conversion by <br />9/24/94. <br />4. The issue of a civil penalty will be considered at the July Board Meeting <br />if an amendment application is filed, and at the September Board Meeting if a <br />Conversion Application is filed. <br />This Cease and Desist Order shall remain in effect until all terms have been <br />satisfied by the operator. <br />In clarification of the rights of recipients of Notices of Violation, Cease <br />and Desist Orders, parties are advised to consult the Colorado Mined Land <br />Reclamation Act and the State Administrative Procedure Act. <br />Nothing herein contained, particularly those portions requiring certain acts <br />to be performed within a certain time, shall be construed as a permit or <br />license to engage in any prospecting or mining operations within the State. <br />Persons concerned with judicial review of the provisions of this Order are <br />advised to consult C.R.S. 24-4-106, as amended. <br />Dated at Denver this`~~day of ("~,,C ,~~ <br />COLORADO MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />MICHAEL B.
