L~ d V. "Buck" Barn~art III IIIIIIiIIIIIIIII
Y
212 West 13th, Pueblo, Colorado 81003
Office: (719) 543-1324 • Home: (719) 542-9207 Fax: (719) 543-1329
January 15, 1999
Mr. Jim Stevens
Division of Minerals and Geology
1313 Sherman Street, Room 215
Denver, CO 80203
Re: Hard Rock Main Plant Gravel Plant (Permit No. M-77-197)
Dear Jim:
RECEIVED
JAN 19 1999
Division of fNirterals & Geobgy
I just received the survey map on this pit, and it unfortunately looks like there are 12 - 14 acres
disturbed outside the permit area. My instructions aze to prepare a 1 12 conversion as rapidly as
possible.
The total of [he property is 37.15 acres according to the survey, which will be the total permit
acreage. The surveyor subtracted the 5.83 undisturbed acres from this to come up with what he calls
31.62 acre area in the permit boundary. Actually, the permit boundary will be the 37. ] 5 acres he
cites, and the affected area will be somewhat less than that after it is determined. I have enclosed
an 8-1/2 x 11" map, which it appears, has been accepted as the pit configuration for use up to this
time. You can see how it fits in with the new survey.
I was involved in this operation shortly after i[ was permitted, and the previous operator requested
me to try to sell it for him. Therefore, I am somewhat familiar with it. I ordered a copy of the
complete file and reviewed it to refresh my memory.
Here are a few items of history to help understand what has happened:
October 28, 1977, Kenneth a Baker, who was attorney for the owner, sent the attached letter to the
Board stating, in effect, that the owner could not either get or afford a bond.
November 1, 1977, Thomas A. Colbert of staff sent Mr. Baker a letter basically telling him to keep
trying and good luck, because a lot of other operators were in the same boat.
September, 1980, I sent the Board a letter on behalf of the owner requesting that the Main Gravel
Pit, Permit SG-77-197, be reduced from 11 A to 9.8 A to make it a 110 operation. I also requested
action on all 3 permits which had been in for 3 years and never acted on.
