The Act and Rules allow the operator to request up to one year to submit an EPP, after <br />the operator's concurrence with the DMO designation. <br />LKA International's 11 /1 5/941etter to the Division concurred with the DMO designation. DMG <br />responded on 02/21 /95 that the EPP due date was set for 8/21 /95 (180 days from letterl. <br />Attachment A - Chronoloov lists the dates of contacts between DMG and the permittee/operator, <br />including extensions requested and granted, and EPP submittals. <br />The permittee/operator has requested several extensions of the deadline date for the EPP <br />submittal, the total time period amounting to over two years (02/21 /95 to 03/01 /971. <br />The operator's most recent request for an extension was approved to the date of 03/01 /97. The <br />operator was notified that the Division does not have authority to extend the deadline again, and <br />that an inadequate and/or late submittal would require that the operator appear before the MLRB <br />at the April 23, 1 997 meeting.
