IV. Enforcement Actions <br />The tollowing iaentifies enforcement actions taken during this inspection, the <br />required abatement and date of abatement for the violation, previous violations <br />still requiring abatement and the termination of violations cited during previous <br />inspections. <br />As an abatement to this violation the Division requires that: <br />1) a) The operator submit within seven li) days of the issuance <br />of this notice, or on Au?L~st 12. 1991, a Technical Revision <br />(TR) to the permit application. The revision shall include <br />design criteria for the haul road showing that it meets the <br />requirements of Rule 4.03.1 and 2.05.3. <br />b) That maps be revised in the permit application to show <br />the location of the haul road; the roads shall also be <br />labeled as such. <br />c) The operating plan for the mine shall be amended to <br />include a description of the use of the haul road. This <br />description shall be of sufficient detail and have the <br />maximum number of truck round trips per day. The type and <br />tonnage of the trucks. And plan shall include the measures <br />that the mine will used to comply with the Colorado Air <br />Emissions Program. <br />2) If a complete application for a TR is received within 7 <br />days, then the Somerset mine has 60 days from the <br />completeness date to obtain the Division's approval. During <br />this time the Somerset mine may continue to receive haul <br />trucks. The Division may grant extensions to this date for <br />administrative delays and for a public comment period. <br />If a TR request is not received within 7 days or if a TR is not <br />approved within 60 days from completeness (or other approved <br />extended date) or if the TR is denied the Somerset mine as an <br />abatement shall immediately cease the coal hauling operation. <br />NOTE: Attach appropriate VIOLATIONS OR CESSATION ORDER CODING FORMS <br />Rev is ea: 4/88 <br />Doc.
