III. Comments - Compliance
Below are comments on the inspection. The comments include discussion of
observations made during the inspection. Comments also describe any
enforcement actions taken during the inspection and the facts or evidence
supporting the enforcement action.
On July 25, 1991 the Division conducted a complete inspection at
the Somerset mine. Present at the inspection was Basil Bear and
Bill Percharich of Somerset Mining Company. At the time of the
inspection the weather was partly cloudy.
The Railroad is continuing to ~+ork en the railroad relocation.
The new railroad bed is now up to final grade. Still to be
completed is the placement of the ballast, track laying and
switching from the old track to the new. Onc= the transfer is
made the old railroad grade will be removed. Construction of the
conveyor and access road alignment is continuing. Workers were
pouring footers for the conveyor. ~ large culvert had been placed
under the access road to Elk Creek. This culvert is about 6 Yeet
in diameter and will allow the conveyor to pass under the road.
.lt the face-up area for the Sanborn Creek Operation 3 entries
were being driven. In the center entry a continuous miner was
actively mining coal and workers were constructing the reinforced
entryway. Work had progressed to about 10 feet into the coal.
Nest to the entry there was a small temporary pile of oxidized
coal and a larger pile of saleable coal. In the center entry,
workers were constructing reinforced archway. The entry would
extend about 30 feet out from the face-up and would be buried
with earth. This would serve to protect workers from falling
rocks from the vertical highwall.
Construction of the sediment pond for the Sanborn Creek operation
is continuing. Work cannot be completed until the old railroad
grade is removed. Presently the railroad grade serves as a berm
.for sediment control.
The inspection continued to the Elk Creek facilities area.
Ditches and culverts were clear; ponds were dry and appeared to
be in good condition. Sediment control along the haul road
appeared to be in good condition. Filter fences were intact and
working.
The reclaimed ventilation fan area st Bear Creek was inspected:
Roads and sediment control were working effectively at this site.
The inspection continued at the shop area where records were
checked. During the records check the following were noted:
1. The NPDES permit expired March 31, 1990, however there
was a letter on file from the D.O.H. that gave an indefinite
extension to the existing permit until a new permit is
issued.
2. The quarterly pond inspection reports were up to date
with the exception the 2nd quarter 1991. Bill Percharich
