NOV C-91-033 <br />Southfield Mine <br />Failure to seed topsoiled area on refuse pile. <br />HISTORY: No violations in the past 12 months. <br />SERIOUSNESS: This violation is moderately serious because failure <br />to seed the topsoiled area during the first appropriate season <br />after application increased the likelihood of losing the topsoil <br />resource. Salvage and use of topsoil for reclamation is an <br />integral part of the reclamation plan for the refuse pile and once <br />topsoil is washed off the pile by surface runoff, it cannot be <br />recovered. Any topsoil washed off the pile would settle into a <br />sediment pond where it would be contaminated by coal refuse <br />materials. <br />FAULT: The operator was negligent in not seeding the topsoiled <br />area within the time frames committed to in the mine plan. <br />GOOD FAITH: $250 good faith is awarded for rapid compliance. <br />c:\wp51\lpr\25e <br />
