<br />-2- <br />NOTICE OF VIOLATION <br />Based upon these same Findings of Fact and in accordance with <br />C.R.S. 34-32-124(6), the Colorado Mined Land Reclamation Board hereby finds <br />Breeze Basin Rock, Inc. to be in violation of Permit M-80-248, specifically <br />special condition 2 on page 2, and C.R.S. 34-32-110(4). <br />CEASE AND DESIST ORDER <br />Based upon these same Findings of Fact and Notice of Violation, and in <br />accordance with C.R.S. 34-32-124(2), (6) and (7) the Colorado Mined Land <br />Reclamation Board hereby orders Breeze Basin Rock, Inc. to: <br />1. Immediately cease and desist all mining operations at~the Lyons Pit <br />No. 2 - Permit M-80-248. <br />2. Mail, within one (1) day after receipt of this Notice, to the Mined <br />Land Reclamation Board, written notice of your compliance with paragraph one <br />(1) of this Cease and Desist Order. <br />3. Complete the following corrective action: <br />Submit the E50.00 annual fee and notice of intent to continue <br />mining (annual report) for 1986 for Permit No. M-80-248 to the Mined Land <br />Reclamation Division by no later than July 24, 1986. <br />4. Pay the Colorado Mined Land Reclamation Board a civil penalty in <br />the amount of 1;200.00, by no later than July 24, 1986. This is based upon an <br />assessment of $200.00 per day for 1 day of violation, February 4, 1986. <br />This Cease and Desist Order shall remain in effect until all terms have <br />been satisfied by the operator. <br />
