-3- <br />SCHEDULE TO NOTICE OF VIOLATION <br />Notice of Violation No.: C-97-005 <br />NATURE OF VIOLATION: <br />Failure to ensure that construction conditions of the Portal to Pond haul road will conVOl or <br />prevent erosion and siltation and will not cause additional contributions of suspended solids to <br />runoff outside the permit area. Failure to properly install erosion control measures at the haul <br />road, pond outslope, and truck loadout areas to minimize erosion and resultant siltation beyond <br />the disturbed areas. <br />ACT, REGULATION, OR PERMIT PROVISION(S) VIOLATED: <br />ACT SECTION(S) 120(2)(d), 120(2)(j)(II)(A), 120(2)(q), 120(2)(x), and 121(2)(j) <br />REGULATION SECTIONS(S) 4.03.1(]), (4.03.1(1)(b), 4.03.1(4)(b)(iii), 4.04.3, 4.05.1(1), 4.05.1(4}, <br />and 4.05.5 <br />PERMIT SECTION(S) Section 2.05: pages 2.05-18 through -20 <br />PORTION OF THE OPERATION TO WHICH THIS NOTICE APPLIES: <br />Mine entrance azea of the Portal to Pond section of the main haul road, truck loadout area, and Pond <br />B outslope. All located in NW'/aSE'/x Section 15, Township 13 South, Range 91 West of the 6th <br />Principal Meridian. <br />STEPS NECESSARY TO ABATE VIOLATION (REMEDIAL ACTION): <br />Properly install or replace all silt fences currently in use or install other measures to ensure that <br />sediment is retained within disturbed areas, and ensure that sediment control is in place at all future <br />disturbed areas prior to their disturbance.
