Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Minerals and Geology (Division) has received your documentation for Technical <br />Revision-02 ("TR-02") for the Chambers Pit, Permit No. M-1980-136. The purpose of the <br />revision was to request permission to begin mining of AREA E under the existing permit, and to <br />request a recalculation of the reclamation bond to include AREA E. However, after review of <br />the documentation submitted for the TR, several issues need to be addressed before the bond can <br />be recalculated and TR-02 approved. The issues to be addressed by the operator aze outlined in <br />the following paragaphs. <br />1. On June 13, 2003, the Division approved the release of AREA A in AR-Ol. This AR <br />reduced the total acreage for the permit from 149 acres to 135 acres. In TR-02, Exhibits C <br />and F (Pre-Mining and Mine Plan Map and Reclamation Plan Map) do not reflect the acreage <br />reduction. Please resubmit Exhibits C and F to show the new permit boundaries following <br />the acreage reduction. <br />2. The mining plan indicates that topsoil and overburden will be stockpiled within the mining <br />area. However, no topsoiUoverburden stockpiles aze shown on Exhibit C, Pre-Mining and <br />Mine Plan Map. Please include ]orations of topsoiUoverburden stockpiles when resubmitting <br />Exhibit C as requested in Item No. 1 above. <br />3. The irrigation ditch shown in AREA E on Exhibit C appears to be relocated on Exhibit F. <br />Who is the owner of the ditch and does the operator have permission to relocate it? If the <br />operator does not own the ditch, the operator needs to provide proof that he has permission to <br />relocate it. <br />4. Numerous manmade structures aze located either inside the proposed mining area or within <br />two hundred feet of the proposed mining azea. These structures include, but aze not limited <br />to, the baseball fields and associated fences, Fairgrounds Road and associated utilities, the <br />buildings in the northeast comer of AREA E, and the existing/relocated itrigation ditch.
