<br />Dear Mr. Shuey:
<br />Western Water & Land, Inc. (W WL), agent for Glenn Springs Holdings, Ina (GSHI), property
<br />manager for Occidental Oil Shale, Ina (OOSI), has revised their original request for release of warranty
<br />(letter dated January 12's, 2005). The revision was made to clearly distinguish reclaimed lands ready
<br />for release from lands that have been revegetated in the last two years and are not yet ready for release,
<br />lands currently undergoing transfer for reclamation jurisdiction to the Colorado Oil and Gas -
<br />Conservation Commission (COGCC), and lands currently being evaluated for permit status by the
<br />Colorado Division of Minerals and Geology (DMG).
<br />In reference to the areas identified in Table 1 of the January, 2005 letter, W WL requests the release of
<br />wartartty for Areas 6, 8, 9, 12, 14, 15, 16, 17, 19, 20, and portions of Area 13 (the Old Surface Process,
<br />New Surface Process, Fast and South of Microwave Tower, and Vicinity of Microwave Tower). These
<br />areas represent a combined acreage of approximately 21.2 acres. According to DMG records, Areas 5,
<br />7, 21, 22, and Areas Bl, B4, B6, B9, B10, and Bl l were previously released in 1986.
<br />W WL understands that Area 18, Logan Wash Road, will remain in the permit, in the case that repair or
<br />maintenance of the retort water pipeline beneath or adjacent to the road is needed in the firtwe. DMG is
<br />in the process of evaluating whether the actual pipeline and evaporation poad are stmctures that have
<br />been incorporated into the existing mine permit. W WL also understands that Area 11, the Guard Gate
<br />Area, was previously removed from the mine permit.
<br />Areas remaining in the permit include portions of Area 13, Miscellaneous Access Roads (Mine Bench
<br />and Portal, and Heater Treater); and Areas 1 through 4 which includes the Upper and Lower Mine
<br />Dump Face, Upper Mine Bench, Lower Mine Bench, and the Research Mine Bench and Dump,
<br />respectively; Area 10, the former Helo Pad; and the Soil Bartow Area (approximately 0.65 acres).
<br />Area 13 consists of the Lower Access Road, which was revegetated in the Fall of 2005, and the Upper
<br />Access Road. The Upper Access Road will remain open until Areas 1 through 4 are ready for release.
<br />The Upper Access Road may also remain open if reclamation jurisdiction of the road and the Lower
<br />Mine Bench are transferred to COGCC as it is anticipated that a gas well is planned to be constructed
<br />on the Lower Mine Bench. Areas 1, 2, 4, and 10 were also revegetated in the Fall of 2005. Areas
<br />remaining for release, not including Logan Wash Road and areas anticipated to be transferred to
<br />jurisdiction of the COGCC, total approximately 29.2 acres.
