Both of the violations require abatement by May 14, 2001, and both violations require <br />that the Frontier bond previously posted for the Bowie No. I Mine (Pern3it No. C-81-038) must be replaced <br />by another bond which fully complies with all applicable statutes and regulations. <br />To date, Bowie Resources Ltd. has posted a replacement bond in the amount of $1,000,000 (one million <br />dollars) for the Bowie No. f Mine. The total required bond amount for the Bowie No. I Mine is $6.450,000 <br />(six million four hundred fifty thousand dollars), thus requiring additional replacement bond in the amount of <br />$5,450.000 (five million four hundred fifty thousand dollars) to abate the above-referenced pending Notices <br />of Violation. <br />The required replacement bond for the Bowie No. 1 Mine must be executed in full no later than May 14, <br />2001. The many circumstances related to this situation prevent us from allowing any further flexibility. We <br />must ensure that the full bond amount required by State Law is in place for the Bowie No. I Mine. Please be <br />advised that if a fully and correctly executed bond is not in place by 5:00 p.m. May 14, 2001, we will be <br />required to issue aFailure-to-Abate Cessation Order which will prohibit all mining and coal loadout-related <br />activities, and which wilt include an order to reclaim [he site.
