This case involves multiple operators at a permitted site, /Y//V' <br />known as the Siloam Mine (located 26 miles southwest of Pueblo). <br />Today we are dealing with two operators Adience, Inc. and Siloam <br />Stone. RTB letters have been sent to Adience, Inc. for failure to <br />protect.... and to Siloam Stone for either mining without a permit <br />or disturbing significant acreage outside the permitted area. <br />Representatives of both companies are present. <br />2. We are here as a result of a site inspection conducted by the <br />Division in December 1996. What prompted the inspection was a <br />complaint letter from the landowner, Mr. Joseph O'Brien of Red <br />Creek Ranch. <br />3. What I am about to explain is a complex permitting and on-site <br />problem. I appreciate your attention. <br />4. As of 1977 the Siloam Mine was a medium sized clay mine. <br />5. In 1977 Mr. Ferd Mueller of Colorado Refractories Corporation <br />submitted~an application for a 110(2) permit for 9.9 acres. Part <br />of the 9.9 acre permit area included the existing disturbance. Mr. <br />Mueller's application was approved by the Board at the Nov. 23, <br />1977 Hearing. At that time Mr. Mueller had acquired clay and rock <br />mineral leases from the State Land Board who was also the surface <br />owner. Mr. Mueller's primary intent was to remove clay, Rock <br />located within the overburded was considered to be a secondary <br />product with market potential. <br />6. Mr. Mueller's activities on behalf of CRC included further <br />development of disturbed areas, establishment of clay and topsoil <br />stockpiles and access roads outside the permitted area. <br />7. In 1990 Mr. N:ueller sold CRC to Adience, Inc. Included in the <br />sale was the clay lease. At that time, CRC then became dissolved <br />as a corporation. <br />8. Since 1990 Adience's activities have involved only removal of <br />clay from clay stockpiles located outside the 9.9 acre area and <br />originally established by CRC. <br />9. Following the- sale of CRC, Mr. Mueller then established a <br />company calle Siloam Sto~~gg which retained the original lease for <br />building stone an ecora~iv ock. ~,i„„r'~ /Q7S <br />10. Since 1990 Siloam Stone's acti~ties include redisturbance of <br />areas disturbed but not permitted in 1977 and disturbance of <br />additional areas surrounding the 9.9 acre permitted site. <br />11.
