• -2- <br />CORRECTIVE ACTIONS <br />1. Require Siloam Stone to secure an approved Construction Material (112) Extraction permit by <br />July 24, 1997 <br />2. Require Siloam Stone to post an interim reclamation bond in the amount of $15,000 <br />by April 25, 1997 <br />CIVIL PENALTY (C.R.S. 34-32.5-123) <br />1. Require Siloam Stone to pay a minimum civil penalty in the amount of <br />$3,663 ,based on 110 hours to staff time at $33.30/hour. <br />2. If the Board finds the operation to be an illegal Construction Material Extraction Operation, the <br />Board should also assess Siloam Stone a civil penalty of not less than $1,000.00 per day nor <br />more than $5,000.00 per day for each day the land has been affected, not to exceed 365 <br />days. <br />a. In this case, the Office recommends that the Board find 61 days of <br />violation at $1,000 per day. <br />b. The total civil penalty of $64.663 (Nos. 1 8 2) is due 30 days <br />from the date of the signed Board Order. <br />c.
