Your figure C-2 Mining Plan Map shows a natural gas pipeline crossing mining cuts 13, 14, <br />16 and 18. (Add the name of the owners of the pipeline to the Exhibit C map, in accordance with Rule 6 Section <br />4.3(g)). The Division considers the pipeline to be significant and valuable. It is obvious that the pipeline, <br />where it crosses the exvac[ion azea, will have to be avoided, protected or moved several yeazs from now when <br />mining approaches it. Provide a notarized agreement between the present owner of the pipeline and Holcim <br />agreeing [ha[ Holcim will compensate the ownez for any damage [o the pipeline. Provide a plan for protection, <br />or removal or relocation of the pipeline. The plan must be reviewed and agreed to in writing by the owner on <br />his letterhead and a copy provided to the Division. If such an agreement can not be reached, the following <br />stipulation will be added to the approval of this proposed amendment. <br />Stipulation No. 1-Holcim will not affect land within 200 feet of the natural gas pipeline located in <br />cuts 13, 14, 16 and 18 without fast having an agreement with the owner of [hat pipeline for protection, <br />removal or relocation of the pipeline. A copy of the agreement, on the owner's letterhead, will be filed with <br />the Division and become a part of the permit. Division approval must be obtained prior to affecting land <br />within 200 feet of the pipeline. <br />
