In accordance with Rule 6 Section 2.1(2)(d), show the proposed permit boundazy on the Exhibit C fig. C-4 and <br />C-6 maps. <br />Exhibit C -Pre-Mining and Mining Plan Maps of Affected Lands <br />2. On an Exhibit C map, provide an Affected Lands Boundazy to satisfy the requirement of Rule 6 Section 4.3(c). <br />This boundary.is separate in this situation from the Permit Bouadazy. The Affected Land boundazy delineates <br />the ]and within the permit [hat is proposed to be affected from land that will not be affected (see Rule 1 Section <br />1(3) for the definition of affected land). Your Exhibit C Maps indicate that there aze azeas within the permit <br />boundary that will not be disturbed by a training activity. An affected land boundazy sepazates those azeas from <br />azeas that aze or will be affected. Permit boundazy lines should be used to delineate azeas previously released <br />from reclamation responsibility. However, if previously released azeas aze [o be re-affected a permiUaffected <br />land boundary should be used to bring such azeas back into the permit. An example of [his is the area that will <br />be affected by the diversion of Bear Creek across land mazked as "released from bond 1990", on the Fig. F-1 <br />map. If the azea marked as "released from bond 1987" has or will be re-disturbed, it should treated the same <br />way. The affected land boundary should at a minimum be placed on the Fig. C-2 and Fig. F-lmaps. It would <br />be desirable to include the boundazy on all Exhibit C maps. <br />3. Please show the location of all active and proposed ground watez monitoring wells. (see Rule 6 Section 4.3(f) ) <br />4. Please explain [he green boundary line on the Fig. C-6 map. What does the line represent? If it is a portion of <br />the permit boundazy, show it as such with a map symbol in a legend. If it is a permit boundary line, why does it <br />include land in the northwest corner not included on other Exhibit C maps? <br />5. Your reclamation plan map in the area where Beaz Creek leaves the affected land area (shown by extraction <br />"cu[" boundary lines) shows contour lines outside that boundazy differing from the existing topography. This <br />topographic change indicates that the land will be disturbed. The mining plan map does not show that the land <br />is proposed to be affected. Please explain this discrepancy. Change your mining plan and or reclamation plan <br />maps as necessazy. <br />Exhibit D -Mining Plan <br />6. Your Exhibit D includes three identical statements of "CONFIDENTIAL INFORMATION provided under <br />sepazate cover." This information was never received. Please provide that information so that it can be included <br />in the amendment review. The Division reminds Holcim that according to RuIel Section 1.3(3) an operator <br />may only mazk as confidential information disclosing the location, size or nature of the deposit or depth and <br />thickness of the deposit and thickness and type of overburden to be removed. All other information required by <br />Lhe regulations can no[ be kept confidential. <br />7. During [hepre-operation inspection conducted on October 10, 2002, the need for sediment control in the Beaz <br />Creek mining azea was discussed. The Division suggested that a sediment retention dam (pond) could be <br />constructed on or near the lower reach of the creek within the permit azea to prevent silt from being deposited <br />on land outside the affected land boundazy or from degrading water quality downstream of your operation. <br />Please provide a sediment control plan including designs for any structure/s, for the Bear Creek drainage / <br />mining azea. <br />
