Dudash <br />Division of Minerals and Geology iryivisiet~ ctt w~lln°t~15.6yu.11c1~y <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 !~ <br />Re: Energy Fuels Mining Company -Raton Creek Mine (Permit No. C-82-055) <br />Abatement Response for NOV C-93-47, Pond Certification <br />Dear Mr Dudash: <br />Due to unexpected setbacks, Energy Fuels Mining Company (EFMC) resppettfull i requests an <br />extension of the abatemen[ date for the part of NOV C-93-47 dealing wi[h pond certtfication. <br />NOV C-93-47 was written for: <br />Failure [o main[ain copies of all records, reports and information required by the <br />regulations at a convenient place in the area of mining. Specific information <br />apparently no[ on file a[ [he mine office includes quar[erly refuse inspections, an <br />updated sedimen[ pond certification, a Curren[ certificate of public liability <br />insurance, and a haul road certification. <br />The steps necessary to abate the violation are specified to include the following actions: <br />Ensure current engineering certification for the sediment pond, refuse pill and <br />haul roads, and a current certificate of insurance are submated to the Diiis[on <br />and pplaced on file a[ the mine office. An alterna[ive to submittal of haul road <br />certification can be submittal of a revision to re-classify the haul road. <br />In response to the requirement for pond certification, EFMC con ratted a registered land <br />surveyor (Mincic Surveying) to survey the pond. After reviewing the survey, discrepancies were <br />noted between [he existing pond and pond designs. EFMC is to the process of reviewing the <br />pond design and developing required modifications to address these discrepancies. OO n or before <br />June 25, 1993, EFMC will submit a Technical Revision (TR) detailing any required changes to <br />the pond design. <br />Upon approval of *.he-pcnd designs, EF&iC ~•ill-make all required modification, io the word. <br />During and upon completion of modifications, the pond will be inspetted and certifiedrby a <br />Colorado Registered Engineer. I <br />This abatemen[ approach should effectively address the part of NOV C-93-47 dealing with the <br />need for a pond certification.
