"CONSUMMATION" - shall mean the accomplishment of all <br />things provided for by the Plan, and an entry of an order by <br />the Court closing this case. <br />"COURT" - shall mean the United States Bankruptcy <br />Court for the District of Colorado, including the United <br />States Bankruptcy Judge presiding in these Chapter 11 cases <br />of the Debtors. <br />"CREDITORS" - shall mean all creditors of the Debtors <br />holding secured claims or unsecured debts, liabilities, <br />demands or claims of any character whatsoever. <br />"DEBTORS" - shall mean Peerless Resources, Inc. <br />"EFFECTIVE DATE" - shall mean the later of: <br />1. Sixty (60) days following the later of the date on <br />which: <br />(a) the time to appeal the Order confirming <br />the Plan, without the consent of the Debtors, has expired if <br />no appeal has been noticed properly therefrom; <br />(b) the time to appeal final judgment rendered <br />with respect to any appeal of the order confirming the Plan <br />has expired; <br />(c) the final judgment has been rendered with <br />respect to any appeal of the Order confirming the Plan with <br />respect to which there is no right to appeal; and <br />2. The date on which an order is entered confirming <br />the Debtors Plan of Reorganization. <br />"PLAN" - shall mean this Plan of Reorganization in its <br />present form or as it may be amended of supplemented. <br />A hearing has been set for the day or <br />1987, at the hour of <br />o'clock .m., for a hearing on the acceptance of the <br />Plan. Creditors may vote on the Plan by filing and mailing <br />out the enclosed acceptance form to the United States <br />Bankruptcy Court, to the Debtors, Debtors counsel or may <br />tender the acceptance in person at the time of the aforesaid <br />hearing. As a creditor, t~.e Debtors feel that your accep- <br />tance of the Plan is important and in order for the Plan to <br />be accepted by Classes Three, Four, Five, Six and Seven by <br />creditors that hold at least two-thirds of the amount and <br />more than one-half in number of the allowed claims of <br />Classes Three, Four, Five, Six and Seven. The two-thirds <br />and one-half of the amounts of claims accepted are computed <br />on a fraction with a denominator that equals the amount or <br />number of claims in a Class.
