§ 34-32-124(6)(a}, C.R.S. authorizes the Board to suspend a permit, upon a determination, after a hearing <br />that a violation has occurred. <br />8. Respondent has no outstanding corrective actions or unpaid penalties, nor any history of violations. The <br />Division reports no onsite or offsite damage, nor any health or safety hazard. Taking into account the <br />Respondent's cooperative attitude and record of compliance, the Board finds it appropriate to assess a <br />penalty of $100.00 per day for each day of the violation, for a total of $300.00. <br />9. Further mineral extraction is not appropriate until an adequate warranty is posted with the Division. <br />ORDER <br />Based on the above findings of fact and conclusions of law, the Boazd orders that the permit for Minerals and <br />Mining, Ltd., M-1983-052 is hereby suspended until such time as the Division has apgroved its new financial <br />warranty. Respondent shall continue to conduct reclamation.
