Jane E. Bunin, PhD
October 21, 1996-Response
Page 7
d ) Documentation of proper procedures for public
notice for the 1989 amendment of M-81-203 .
Response The Division has located in the correspondence
file, copies of signed green cards showing that
various persons where notified of the amendment
application. There is also a copy of the proof of
publication which was published 4 times during
each of 4 successive weeks beginning on September
1, 1989 . The Division determined that these items
meet the requirements of our regulations for proof
of public notice.
e) Reclamation Plan calls for four lakes, whereas the
current operations are apparently creating more
wetlands and fewer lakes Does this require
permitting?
Response The Division was informed earlier this year that
the operator will be submitting a revision to the
reclamation plan to change the number of lakes .
The change will require a change in the
reclamation plan.
f) Flatiron applied for a Technical Revision (T.R.
received by MLRD 3/4/96) for the Turnpike Pit
concerning drainage. The corresponding T.R. for
the Deepe Pit was expected within the month after.
What is the status of this earthwork and any
modifications of the Deepe Pit permit?
Response Recent communications with Western Mobile
indicated that they still intend to submit a
revision which will change the number of lakes and
some of the final grading and drainage plans . The
Division does not know when the revision will be
submitted.
The Division does not believe that a violation exists at this
time in reference to grading activities . We will notify you if
we receive any permitting actions for either the Deepe Pit or the
Turnpike Pit . If you have any further questions, please feel
free to contact us .
Sincerely,
Gregg R. Squire
Environmental Protection Specialist
